These Terms of Service ("Terms") govern your access to and use of the Trace platform provided by Tracehub ("we", "us", or "our"). By accessing or using our service, you agree to be bound by these Terms.
1. Definitions
- "Service" refers to the Trace platform, including all features, tools, and content.
- "Tenant" refers to the organization or company that has subscribed to the Service.
- "User" refers to any individual authorized by a Tenant to access the Service.
- "Content" refers to all data, text, files, and materials uploaded to or generated within the Service.
2. Account registration
To use the Service, you must be invited by a Tenant administrator or register through our onboarding process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to the Service, other accounts, or computer systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Upload malicious code, viruses, or any other harmful content.
- Reverse engineer, decompile, or disassemble any aspect of the Service.
- Share your account credentials with unauthorized third parties.
4. Subscription and payment
Access to the Service requires a paid subscription. Pricing, features, and limits are determined by your selected plan as described on our pricing page. Subscriptions are billed monthly or annually in advance. All fees are non-refundable unless otherwise stated.
We reserve the right to modify pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
5. Data ownership
You retain all ownership rights to the Content you upload to the Service. We do not claim any intellectual property rights over your Content. By using the Service, you grant us a limited license to process, store, and display your Content solely for the purpose of providing the Service.
We will not access your Content except as necessary to provide the Service, respond to support requests, or comply with legal obligations.
6. Availability and support
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We provide support via email for all plans, with priority support and dedicated onboarding available on higher-tier plans as described on our pricing page.
7. Audit trail integrity
The Service maintains a tamper-proof audit trail of all control completions, approvals, and rejections. Once recorded, audit trail entries cannot be modified or deleted by any user, including administrators. This ensures the integrity and reliability of compliance records.
8. Termination
Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms.
Upon termination, we will retain your data for 30 days to allow for export. After this period, all data associated with your Tenant will be permanently deleted unless retention is required by law.
9. Limitation of liability
To the maximum extent permitted by applicable law, the Service is provided "as is" without warranties of any kind, whether express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Our total liability for any claim arising from the Service shall not exceed the amount paid by you in the twelve (12) months preceding the claim.
10. Governing law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved by the competent courts in Stockholm, Sweden.
11. Changes to these Terms
We may update these Terms from time to time. We will notify Tenant administrators of any material changes at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
